News Articles Blog

When a father faces the possibility of having to fight for the custody of his children in a California divorce or some other legal proceeding, he faces an excruciatingly difficult process that will almost assuredly place serious strain on his ability to make sound and logical decisions. That\’s only one of many reasons that any father in this position should seek the immediate help of child custody lawyers in San Diego who can help him through this process. However, simply hiring men\’s divorce lawyers who quickly return a call or an email is not the necessarily the best way to go about securing this critically important help. Below you\’ll find some ideas to consider when searching for a San Diego child custody attorney who can handle this type of situation.

Experience – There is No Substitute

Legal issues regarding child custody are as emotionally charged and complicated as almost any other type of legal matter. Therefore, when a father seeks this type of help, he should seek child custody lawyers in San Diego who have a wide range of experience when it comes to these legal battles. That\’s because experience will allow a San Diego child custody attorneyto manage not only the legal situation on the merits, but also the psyche of the father who is struggling to deal with the challenges presented by this process.

Track Record – Past Success is Critical

Most people understand that hypothetically, fathers will face a difficult challenge when it comes to winning custody of their children when the mother is on the other side of the courtroom. However, earning a positive result in these situations is far from impossible, and men\’s divorce lawyers who have been fighting successfully on behalf of fathers can and should be found so that the father facing this battle can give himself the best chance possible for success.

Service – Communication is Key

As stated above, few if any legal issues that can arise are more filled with complicated emotions than child custody issues. Therefore, fathers will need to work with child custody lawyers in San Diego who make it a priority to provide a high level of service to clients dealing with these situations. This service usually plays out in the form of regular communication, as fathers who are informed of what\’s happening with a case will generally have an easier time handling developments than those who are wondering what could be happening at any given time. If you are facing the possibility of fighting for your children, you need to seek the help of child custody lawyers in San Diego who have been fighting successfully for fathers for many years.
When you have children, you likely hope that you can provide the happiest and healthiest life possible for them. You also likely hope that you will never face a situation where you will be fighting with the other parent of your children over which of you the children will be living with. Unfortunately however, these situations do occur and if it happens to you, you will probably want to be equipped with all of the tools necessary to win the battle.

When you do find yourself fighting with the other parent of your children over which of you the kids will be living with, you might want to look into the option of hiring a child custody attorney. This is likely uncharted territory for you and you are probably feeling overwhelmed and concerned about making the right moves throughout the process. When you hire a legal professional, they will be able to help ease your concerns and answer all of the questions that are likely going through your mind.

A benefit of having a child custody attorney on your side throughout this process is that you will have a professional on your side that specializes in these types of cases. Just know that this legal professional has dedicated their career to these types of cases can make you feel much more confident in your ability to win this custody case. Additionally, you will probably want to have this type of lawyer on your side if the other parent of your children is also planning on hiring a legal professional.

Although you may think that you will be able to handle this case on your own and are confident that the court will see how great of a parent you are and award you full custody, it can take only one bump in the road to set you completely off track from your plan and threaten the success of your case. When you hire a child custody attorney, you can rest easy knowing that they have gone through many of these cases and have the expertise to successfully handle any roadblocks. Because, although you may be the greatest parent in the world, it can take only one curveball from the other parent to take the opinion of the court of your favor.

Another benefit of hiring a child custody attorney is that they will be building up knowledge about your case from the beginning in case any issues arise in the future after this battle has been settled. Unfortunately, the first custody battle that you go through will often not be the last. Many times, one side or the other will not be happy with the ruling of the court and will challenge it down the road. If you have had a legal professional on your side from the beginning, they will quickly be able to dive into the case once again instead of hiring someone new down the road that will take a while to become acquainted with everything that has taken place.

When fathers face the end of a marriage and there are children of that marriage, they must overcome several perceptions and ideas that can lead to negative thoughts and in the worst cases desperation. The fact of the matter is that, despite perceived norms, fathers can and many times do win custody of their children. However, this effort should only be made with the help of family law attorneys in San Diego, CA who have helped fathers through this issue successfully in the past.

Below you\’ll find information regarding how the help of a divorce lawyer in San Diego can be critically important for any father who wants to make his best effort to be awarded custody of his children. You will also find information regarding how you can contact an experienced child custody attorney in San Diego to schedule an initial consultation.

Sound, Logical Decisions

When child custody becomes an issue, the strategy behind this battle will in many ways define the result. Therefore, the strategic decisions that are made in furtherance of a father\’s case in court will have an enormous impact on the ultimate outcome. These decisions need to be logically sound for obvious reasons, and a father who is fighting for his children is often dealing with enormously powerful emotions that can cloud logic and decision making. Family law attorneys in San Diego, CA who have handled these cases in the past can make these decisions with a proper mindset.

Providing Perspective

As stated above, when fathers face a battle over the custody of their children, they must simultaneously deal with extremely powerful emotions. As a result of this emotional difficulty, it can be nearly impossible for a father to understand completely how this process works and what steps need to be taken to earn a positive result. A divorce lawyer in San Diego who has the experience necessary to deal with these situations will also be able to help a client understand what needs to be done, what steps need to be taken and generally what it takes to put this difficult time in the past.

Serving as a Relentless Advocate

Given the emotions involved on both sides of a child custody battle, these issues can and often do take a tremendous toll on anyone who is involved in them. Therefore, the need for relentlessness and focus is as extreme as with any legal issue. A child custody attorney in San Diego earns his or her reputation in part by his or her ability to maintain the advocacy required to earn a positive result.

If you are facing the possibility of fighting for the custody of your children, you need to seek the help of family law attorneys in San Diego, CA who have been fighting for fathers successfully for many years. Contact the Men\’s Legal Center today to schedule an initial consultation.

Child custody attorneys are widely available in every state and jurisdiction. But your choice of attorney when filing for child custody will be vital to give yourself the best chances of success. In this article I look at what you must check out before engaging the services of child custody attorney.

The first critical point is that your attorney must be familiar with the child custody laws in the state or jurisdiction that your legal battle will be fought in. The laws on the statute books do vary from state to state and it is obviously key that your attorney is fully up to speed in the laws of that jurisdiction.

The second vital component in your choice of attorney when filing for child custody is that your attorney practices law in this area. There are huge differences between the different areas of law like criminal, marital, business, litigation and so forth.

The approach to be adopted by your attorney on the breakdown of a relationship is widely different than that to be adopted when involved in a criminal trial or corporate takeover battle. You will need to ensure therefore that your lawyer is a) familiar with the laws of the state that has jurisdiction in the matter and b) that your attorney is familiar with the nuances and practices needed in child custody cases.

The best approach to take is by obtaining references from people who have been through the process before. Now is not the time to pick up the phone book and thumb through it. You will need to do some research beforehand to ensure that your attorney is going to be an asset in your corner..and not a liability when the heat is on.

In conclusion your choice of attorney is critical..that is why you need to assess the available child custody attorneys very closely.

For men, divorce can be hard enough even when there are no kids involved. However, for men in the midst of an Illinois child custody battle, the path to reaching a working custody arrangement with an ex-spouse can be a long and emotionally draining process. Historical court rulings and the media seem to keep telling us that men have many hurdles to overcome when it comes to visitation and custody rights.

What Dads Need to Know About Child Custody

Traditionally, men tend to believe that they have no options when it comes to their parental rights. They believe that the court system favors women time and again, and routinely denies fathers access to custody or visitation with their children. For many men, this is a scary prospect. However, when fathers hire Illinois child custody lawyers to help secure their rights to remain an important part of his children\’s lives, they have a better chance of staying in contact with their kids.

How to Select a Custody Attorney

Ask for recommendations. You will feel more comfortable working with Illinois child custody lawyers who are recommended by someone you trust. If your personal contacts can\’t make a recommendation, ask for testimonials and references from the attorneys you are considering.

Search for a local attorney. If you don\’t have any idea where to being, try a web search. This can help you narrow down options and find an attorney in your area that specializes in child custody cases. For example, if you live in the Chicago area, a good search phrase might include child custody attorney Chicago.

Find an attorney who believes in fighting for a father\’s rights. It sounds obvious, but it can be easily overlooked. You need someone who is on your side, someone who will fight diligently to represent your best interests.

Can Female Attorneys Represent Fathers Effectively?

Of course. In fact, some people believe that a female Illinois child custody attorney may be favorable for fathers in custody cases. Women are often seen as more understanding and sympathetic in the eyes of the court. This does not mean you should rule out hiring a male custody attorney. The most important thing is to be aware of the potential bias and make your decision accordingly.

How Do I Know if My Attorney Has Enough Experience?

When you consider hiring an attorney, get as much information as you can about his or her track record in custody disputes. Talk to references and past clients. Many attorneys can put you in touch with former clients who are willing to speak about their experiences.

You can also check with legal and professional associations in your area. If there are any red flags regarding a lawyer\’s past experiences, you may be able to find them by checking with the Bar Association or the Better Business Bureau.

Fathers today should not assume that a divorce will automatically strip them of their rights to be involved in their children\’s lives. Hiring the right attorney can help ensure they will have the opportunity to stay closely connected with their children as they grow into adults.

There is a lot of legal jargon involved when divorcing and determining child custody, and though your child custody lawyer will lead you through the process it is sometimes hard to know exactly what you need to ask. Understanding some of the basic legal terms involved in child custody can make communicating with your child custody attorney easier, and help ensure you can ask for the things you most want or need during negotiation.

Terms for Types of Child Custody

1) Legal Custody

If a parent has legal custody, then they have the right to make legal decisions for the child without consulting the other parent. These decisions include educational options, religious upbringing, medical treatment and similar issues.

2) Physical Custody

If a parent has physical custody of a child then the child physically resides at their address. They have the responsibility of providing for the child’s day to day needs. This is not the same as legal custody; all major legal decisions for a child are still the joint responsibility of the child’s parents.

3) Joint Custody

Joint custody is the term used a for custody arrangement when parents have equal physical access to, legal responsibility for and financial support of their child or children. These parents typically live in the same community so that children can move easily or freely between the homes during the week.

4) Sole Custody

Sole custody is the term used for a custody arrangement where only one parent has access to and legal responsibility for the child. The non-custodial parent typically has a limited visitation schedule and is still required to pay child support.

Contractual Terms

1) Parenting Plan

Parenting plan, or parenting arrangement, is the term used for the contract that is drawn up between the parents which outlines discipline style, details of the custody and visitation arrangement, division of holidays, payment of child support and other legal issues pertaining to the children.

2) Mediation

Mediation is the discussion that occurs with child custody lawyers, and in some cases a third party arbitrator, to resolve custodial disputes, rather than taking it to court. This is typically a less formal forum for discussion and results in a less stringent and more personalized custody arrangement.

3) Litigation

Litigation is the term for a judge’s role in resolving custodial disputes. A custody battle is litigated when it goes to court.

4) Child Custody Evaluator

A child custody evaluator is a member of the mental health community called on by the court, or a child custody lawyer, to evaluate the custody arrangement and each parent’s fitness, to determine what kind of arrangement best serves the socio-emotional needs of the children.

Deciding how custody of the children will be divided is often the most expensive, and the most emotionally charged element in a divorce case. Assets like retirement plans, homes and other material possessions have a cash value, and at some point both parties realize that the fight to keep the assets is costing more than the asset’s actual worth. For most parents, however, children are priceless and there is no amount of money they would not spend protecting their time with their children. Negotiating child custody arrangements outside of court, with the assistance of child custody lawyers, can save the parties involved a significant amount of money, and make the divorce and custody process less painful for the children.

Negotiating a custody arrangement in mediation rather than before a judge is generally in the best interest of everyone involved. When a judge is forced to litigate child custody, he is looking at the best interest of the children and not the parent’s convenience. Custody arrangements devised by the two parents together is more fluid and more flexible. For example a litigated custody arrangement may have strict every other weekend arrangements, with two weeks of continuous visitation in the summer. This does not allow parents to flex visitation around family dinners, other family vacation plans or school activities. Parents who negotiate their own terms can build exceptions and provisions to meet their own interests and needs as well as their children’s. Negotiation also, typically, leads to a happier resolution, with less ongoing feelings of anger and resentment, which could damage the children’s relationship with one or both parents.

Negotiating a custody arrangement rather than allowing it to be litigated also saves a significant amount of money. The time required to assist a client’s navigation of a negotiation proceeding is significantly less than the time required for a child custody attorney to prepare for a legal battle before a judge. Negotiating out of court will save both parents court costs, lawyer retainer money and require less time off work than allowing the custody case to go before a judge.
